1. Acceptance of Terms
By accessing and using the services of TopGear Adventure Dubai ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
These terms apply to all bookings, reservations, vehicle rentals, tours, and any other services provided by TopGear Adventure Dubai.
2. Booking and Reservations
2.1 Booking Process
- All bookings are subject to availability
- Bookings must be made through our official website or authorized channels
- You must provide accurate and complete information when making a booking
- A booking confirmation will be sent via email or SMS
- We reserve the right to refuse or cancel bookings at our discretion
2.2 Payment Terms
- Full payment may be required at the time of booking or upon arrival
- We accept cash, credit cards, and other approved payment methods
- All prices are in UAE Dirhams (AED) unless otherwise stated
- Prices are subject to change without notice, but confirmed bookings will be honored at the agreed price
- A security deposit may be required for vehicle rentals
3. Vehicle Rental Terms
3.1 Driver Requirements
- No driver's license is required - beginners are welcome
- No minimum age requirement - drivers of all ages are welcome (parental consent may be required for minors)
- Drivers must complete the mandatory safety briefing before operating any vehicle
- Drivers must provide proof of adequate travel and health insurance coverage
- Drivers must sign all required liability waivers and acknowledgment forms
- We reserve the right to refuse rental to any driver we deem unfit or who fails to meet any requirements
3.2 Vehicle Use and Safety Rules
All drivers must strictly adhere to the following rules, which are reinforced during the mandatory safety briefing:
- Vehicles must be used only on designated routes and areas as specified during the safety briefing
- Off-road driving is permitted only in designated areas approved by our guides
- All safety equipment (helmets, seatbelts, protective gear) must be worn at all times
- Vehicles must not be used for illegal purposes
- Maximum passenger capacity must not be exceeded
- Speed limits and safety guidelines provided during the safety briefing must be followed
- No driving under the influence of alcohol or drugs (zero tolerance policy)
- Vehicles must not be modified, tampered with, or used in ways not authorized
- Vehicles must be returned in the same condition as received (normal wear excepted)
- Any violation of safety rules may result in immediate termination of rental without refund and full liability for damages
3.3 Damage and Liability
IMPORTANT: The driver accepts full responsibility and liability for any and all damage to the vehicle, regardless of cause or circumstances. This includes, but is not limited to:
- All damage to the vehicle during the rental period, including mechanical damage, body damage, tire damage, and interior damage
- Damage caused by accidents, collisions, rollovers, or any incidents
- Damage resulting from misuse, abuse, or negligence
- Damage to vehicle components, accessories, or equipment
- The driver is fully liable for repair costs, replacement costs, loss of use, and any other expenses related to vehicle damage
- Security deposits may be used to cover damages, but the driver remains fully responsible for all costs exceeding the deposit amount
- We are not liable for personal belongings left in vehicles
- Renters must report any accidents or incidents immediately
4. Desert Safari Tours
4.1 Tour Participation
- All participants must attend and complete the mandatory safety briefing before tour participation
- Participants must follow all safety instructions provided during the safety briefing and by guides
- Participants must provide proof of adequate travel and health insurance coverage
- Participants must sign all required liability waivers and acknowledgment forms
- No minimum age requirements - participants of all ages are welcome (parental consent may be required for minors)
- Pregnant women and individuals with certain medical conditions may be restricted from some activities
- We reserve the right to refuse participation to anyone we deem unfit or who fails to meet any requirements
4.2 Tour Modifications
- Tour routes and activities may be modified due to weather conditions or safety concerns
- We are not liable for changes due to circumstances beyond our control
- No refunds will be provided for activities missed due to participant's failure to follow instructions
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellations made 48 hours or more before the scheduled time: Full refund minus processing fees
- Cancellations made 24-48 hours before: 50% refund
- Cancellations made less than 24 hours before: No refund
- No-shows: No refund
5.2 Our Cancellations
We reserve the right to cancel bookings due to:
- Severe weather conditions
- Safety concerns
- Mechanical issues
- Other circumstances beyond our control
In such cases, we will offer a full refund or reschedule the booking at no additional cost.
6. Safety Briefing and Risk Acknowledgment
6.1 Mandatory Safety Briefing
All participants must attend and complete a mandatory safety briefing before any activity. The safety briefing includes:
- Vehicle operation instructions (starting, stopping, turning, driving on sand)
- Safety equipment usage (helmets, seatbelts, protective gear)
- Designated routes and areas
- Emergency procedures and contact information
- Rules and regulations for safe operation
- Environmental awareness and wildlife precautions
Participation in any activity without completing the safety briefing is strictly prohibited and will result in immediate termination of service without refund.
6.2 Full Own Risk for Injury and Personal Harm
CRITICAL: By participating in any activity, you acknowledge and accept that you participate entirely at your own risk and accept full responsibility for all risks of injury, harm, or loss, including:
- Full own risk (100% eigen risico) for all injuries, including but not limited to:
- Physical injuries, fractures, cuts, bruises
- Head injuries, spinal injuries, internal injuries
- Death or permanent disability
- Any medical expenses, hospitalization costs, or rehabilitation expenses
- Risk of accidents, collisions, or rollovers
- Vehicle breakdowns or mechanical failures
- Weather-related hazards (heat, sandstorms, etc.)
- Wildlife encounters
- Terrain-related hazards (dunes, rocks, slopes, etc.)
- Equipment failure or malfunction
- Actions of other participants
You are fully responsible for your own medical expenses, travel insurance, and health insurance. We do not provide any insurance coverage for injuries, medical expenses, or personal harm. Participants are strongly advised to have comprehensive travel and health insurance coverage.
While we provide safety equipment and instructions, you are solely responsible for following all safety guidelines, using safety equipment properly, and operating vehicles in a safe manner.
7. Liability Limitations and Exclusions
To the maximum extent permitted by law, and as expressly acknowledged by you:
- We accept NO liability for any injuries, harm, death, or personal damage - Participants accept full own risk (100% eigen risico) for all injuries and medical expenses
- We accept NO liability for vehicle damage - The driver is fully liable for all vehicle damage regardless of cause
- We are not liable for indirect, consequential, or incidental damages
- We are not responsible for loss or damage to personal belongings
- We are not liable for delays or cancellations due to circumstances beyond our control
- Participants are solely responsible for their own medical expenses, travel insurance, and health insurance
- We are not liable for any claims, lawsuits, or legal proceedings arising from participation in our activities
- By participating, you waive all rights to claim damages, compensation, or liability from TopGear Adventure Dubai, its employees, agents, or representatives
8. Insurance and Coverage
IMPORTANT: Vehicles are NOT insured. There is NO insurance coverage provided for:
- Vehicle damage of any kind - the driver is fully liable for all vehicle damage
- Injuries, medical expenses, or personal harm - participants accept full own risk (100% eigen risico)
- Third-party damage or claims
- Loss of use or business interruption
Mandatory Requirements:
- All participants must have their own comprehensive travel insurance that covers adventure activities and off-road vehicle operations
- All participants must have their own health insurance that covers medical expenses, hospitalization, and emergency care in the UAE
- Participants are responsible for ensuring their insurance coverage is adequate for the activities they will participate in
- We reserve the right to request proof of insurance coverage before allowing participation
By participating in any activity, you confirm that you have adequate insurance coverage and understand that TopGear Adventure Dubai provides NO insurance coverage of any kind.
9. Prohibited Activities
The following activities are strictly prohibited:
- Driving under the influence of alcohol or drugs
- Reckless or dangerous driving
- Removing vehicles from designated areas
- Carrying more passengers than vehicle capacity
- Smoking in vehicles
- Any illegal activities
- Damaging or defacing vehicles or property
Violation of these rules may result in immediate termination of service without refund and liability for damages.
10. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of TopGear Adventure Dubai and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.
11. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
12. Dispute Resolution
Any disputes arising from these terms or our services shall be governed by the laws of the United Arab Emirates. We encourage resolving disputes through direct communication. If a dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
